Call to Order: Mayor Daffern call the meeting to order at
Invocation and Pledge: Mayor Daffern led the pledge and silent prayer.
The purpose of this Special Meeting was to hold a workshop on Planning and Zoning Laws and Regulations given by City Attorney, Paige Saenz. Items discussed are:
1. Overview of Zoning Laws and Regulations
2. Overview of Subdivision Laws and Regulations
3. Discussion about zoning regulations for the City of

Citizens Comments – Citizen Carol Wester addressed the council stating that she and her husband have purchased the trailer park on Discussion and possible action items: A. Discuss oak trees and tree trimming in the right-of-way on B. Discuss and possible approval of ordinance to put sales tax on November ballot – Councilmember Reinke made the motion that the City adopt a sales and that the City Attorney draw up the verbiage for the ballot for either 1 percent or 1 and ½ percent. Councilmember York seconded and the motion passed by vote 5-0. C. Discussion of ad valorem/property taxes, process of authorizing City Council to levy and possible approval of action – Councilmember Reinke motioned that the Council continue researching the process of adopting a property/ad valorem tax and having it as an agenda item at a later date. Councilmember Huebner seconded and the motion passed 3-2 with Councilmember’s Reinke, Huebner, and Wester voting yes and Councilmember’s D. Invocation and Pledge: Mayor Daffern led the pledge and silent prayer.
Citizens Comments – none
Approval of minutes – Councilmember Wester motioned and Councilmember York seconded that the minutes be approved, passed 5-0.
Financial Report – City Secretary/Treasurer DeVere stated that the Administrative expenses were changed from $87.75 to $50.00 for the ad in the newspaper. Councilmember Wester motioned and Councilmember Reinke seconded that the report be approved, passed 5-0.
Discussion and possible action items:
A. City Sales Tax Ordinance – the council members had been sent a copy of the ordinance as prepared by the City Attorney. Councilmember Reinke made the motion that the ordinance regarding the 1% sales tax be dealt with before discussing possible purposes for the other percentages of the sales tax. Councilmember Wester expressed concern over the “selling” of the sales tax to the citizens or we face the possibility of defeat. Mayor Daffern suggested a letter go out to the citizens why the sales tax is being put on the ballot as well as a possibility of a public hearing. Councilmember Reinke took his previous motion off the table and made a motion that the ordinance as written by the City Attorney be accepted and turned into Sue Basham, County Elections Administrator, to be put on the November ballot. Councilmember York seconded the motion and it passed 4-0 with Councilmember Wester abstaining.
Councilmember Wester made the motion that the additional percentage on the ballot be designated for street maintenance. Motion dies for lack of second.
Councilmember Reinke made the motion to accept the ordinance for the Municipal Development District be accepted and included on the November ballot. Councilmember Huebner seconded the motion. Councilmembers Reinke and Huebner voted yes to accept the motion, Councilmembers Wester and Clark voted no, and Councilmember York abstained. Mayor Daffern voted yes to break the tie vote. Motion passed.
B. A Public Hearing date was set for August 30, 2010. This is to discuss and approve the City of Staples 2010-2011 proposed budget before the September 1st deadline.
Announcements by council members and citizens
· Mayor Daffern cancelled the public hearing on August 24th for the Planning and Zoning Committee proposed zoning plans due to need for more work on the plans.
· Councilmember Wester announced that trees in the City’s right-of-way have been trimmed and the arborist has been paid.
Motion to adjourn was made by Councilmember Wester with a second by Councilmember York , passed 5-0 and meeting was adjourned at 7:48 pm.

Meeting was reconvened at Councilmember Wester made the motion to approve the City of Staples 2010-2011 proposed budget. Councilmember Reinke seconded and the motion was passed 4-0. Motion to adjourn was made by Councilmember Wester with a second by Councilmember Hueber.
